The Florida Wrongful Death Act enables family members of the decedent to collect damages from the organization or person(s) they believe to have caused the decedent’s death. While a wrongful death lawsuit benefits all family members and other with an “interest,” the only individual who can file a wrongful death claim in Florida is the personal representative of the estate. This person is either directly listed in the will or estate plan; alternately, the court determines whom this individual will be.
